2. Client Responsibilities
Clients are responsible for providing accurate information, content, images, credentials, approvals, and other materials required for completing a project.
Clients must ensure that any content or materials provided to KGN Solutions do not violate the intellectual property, privacy, or other legal rights of third parties.
Delays in providing required materials or approvals may affect project timelines.
3. Project Scope and Changes
All projects are completed according to the agreed scope of work. Requests outside the agreed scope may result in additional charges and changes to the delivery timeline.
Significant changes to project requirements may require a revised quotation or agreement.
4. Payments
Project fees, advance payments, milestones, recurring charges, and other applicable costs will be communicated before or during the engagement.
Third-party costs such as domain registration, hosting, premium plugins, themes, software licenses, APIs, and advertising budgets may be charged separately unless otherwise agreed.
KGN Solutions reserves the right to pause or suspend services for overdue payments.
5. Digital Marketing Services
SEO, Google Ads, and social media marketing depend on search engines, advertising platforms, algorithms, competition, and market conditions.
KGN Solutions does not guarantee specific search rankings, traffic, leads, sales, advertising results, or social media growth.
Advertising budgets paid to third-party platforms are separate from KGN Solutions’ service fees unless specifically stated otherwise.
6. Hosting Services
Where hosting services are provided, we make reasonable efforts to maintain reliable and secure hosting. However, uninterrupted availability cannot be guaranteed.
Hosting services may be suspended due to non-payment, security concerns, misuse, violation of these Terms, or other legitimate technical reasons.
7. Intellectual Property
Clients retain ownership of materials they provide to KGN Solutions.
Unless otherwise agreed, KGN Solutions retains ownership of its pre-existing code, frameworks, tools, reusable components, development methods, and other proprietary materials.
Upon receipt of full payment, rights to the agreed client-specific deliverables will be transferred or granted according to the project agreement.
Third-party software, plugins, themes, fonts, images, and other licensed materials remain subject to their respective licenses.
8. Third-Party Services
Projects may depend on third-party platforms, software, APIs, hosting providers, payment gateways, advertising platforms, or other external services.
KGN Solutions is not responsible for interruptions, policy changes, pricing changes, limitations, or discontinuation of third-party services.
9. Confidentiality
Both parties agree to take reasonable steps to protect confidential business, technical, financial, and other sensitive information shared during a project.
This obligation does not apply to information that is publicly available or required to be disclosed by law.
10. Cancellation and Termination
If a project is cancelled after work has commenced, the client may be responsible for payment for work completed and any non-refundable third-party costs already incurred.
KGN Solutions may suspend or terminate services for non-payment, misuse, unlawful activities, or material violation of these Terms.
11. Disclaimer and Limitation of Liability
We provide our services with reasonable professional care but do not guarantee that websites, applications, hosting services, or marketing campaigns will always be uninterrupted or error-free.
To the extent permitted by applicable law, KGN Solutions will not be liable for indirect or consequential losses, including loss of profits, revenue, data, or business opportunities.
12. Privacy
Information collected through our website and services is handled in accordance with our Privacy Policy, which forms part of these Terms.
13. Changes to These Terms
KGN Solutions may update these Terms from time to time. Updated Terms will be published on this page with a revised effective date.
14. Governing Law
These Terms shall be governed by the laws of India. Subject to applicable law, disputes shall be subject to the jurisdiction of the appropriate courts in India
